General Conditions
Before confirming a reservation, we recommend that you carefully read the following terms and conditions. ViVi Holiday Homes SL is a registered company in Spain with the number B93728483, operating commercially under the name "ViVi Homes," hereinafter referred to as "the company."
Prices
The prices on "the company's" website are per person, per apartment, and per night unless otherwise indicated. All prices are in euros unless stated otherwise and include all applicable taxes. Prices are subject to change at any time without affecting existing reservations, except in the case of changes in legal or regulatory taxes imposed by the competent authorities. Prices include full property cleaning before and after each guest's arrival and departure, property maintenance, water, electricity, gas, and Internet costs, as well as customer service during office hours. In case of emergency, you can reach us 24 hours a day by calling +34 951 128 003. Extras such as parking, cleaning, cribs, high chairs, etc., are available at an additional cost.
Booking Process Conditions
Once you have made a reservation for one of our accommodations, you will receive a written confirmation with the dates and prices of the reserved accommodation, payment conditions, and any additional services you have contracted. You will receive instructions on how to reach the accommodation, where a member of our staff will be waiting to hand over the keys, show you around, and answer any questions you may have. In many ocassions you may be directed to a key-box where you will find the keys, or you may be given a code to open the doors electronically or via an app.
Payment Methods and Reservation Fees
To make a reservation, you must pay non-refundable reservation fees to secure the accommodation. Payment of these reservation fees formalizes your contractual relationship with ViVi Holiday Homes SL (ViVi Homes). Payment conditions:
- Reservation fees amount to 30% of the total reservation price, depending on the accommodation. You will be charged immediately after booking.
- Once paid, these reservation fees are non-refundable (see our cancellation policy).
- The remaining balance must be deposited into our bank account 4 weeks before your arrival to confirm the reservation. If your arrival date is within 4 weeks, the total rental amount will be deducted at the time of confirmation. Please contact us if you need special payment conditions.
- If you have booked your apartment or property through an external provider (e.g., Airbnb, Booking.com, HomeAway, etc.), please note that you are obliged to comply with the terms and conditions of that external provider, whether for payment, booking, or cancellation.
Change of Reservation
Generally, we cannot change a reservation once confirmed. However, if you wish to change any aspect of a reservation, please inform us as soon as possible by contacting us via email at reservations@vivi-homes.com. We will do our best to assist where we can.
Cancellation Policy
Cancellations must be made in writing to reservations@vivi-homes.com. The following cancellation fees apply:
- More than 4 weeks before arrival: Loss of the 30% prepayment.
- 4 weeks or less before arrival: 100% of the total reservation price.
If, due to circumstances, the apartment is not available for occupancy, 'the company' reserves the right to move you to an alternative accommodation of similar characteristics at no additional cost. If for any reason we cannot relocate or provide alternative accommodation, 'the company' reserves the right to move you at no additional cost. If "the company" cannot find an alternative place, the reservation will be canceled, and the full amount will be refunded. However, if the reservation is canceled due to reasons attributable to the guest or their personal circumstances, the reservation amount will not be refunded.
Access to Accommodation / Check-in
Check-in and check-out times may vary depending on the accommodation, but as a general rule, check-in is from 4:00 PM on the first day indicated in the reservation confirmation, regardless of the arrival time in Malaga. We do our best to reduce waiting times. In cases where the accommodation is available before the indicated time, we will try to allow you to enter earlier. If there is a change in travel plans or arrival time in Malaga or an unexpected event prevents you from reaching the accommodation at the agreed time, please notify us as soon as possible to arrange a new time. Please inform us upon arrival at Malaga airport or 30 minutes before arriving at the apartment so that we can ensure to be there to welcome you. If you cannot reach your designated contact person, please contact our emergency number: +34 951 128 003.
Contract and Registration
Before your arrival, you must sign a contract with ViVi Homes and provide us with your legal documentation and that of all your companions. This procedure is mandatory for all guests including minors, in accordance with current Spanish legislation. Any guest who refuses to do so will not be granted access to the property without this procedure.
Departure from Accommodation / Check-out
In general, check-out and key return take place before 11:00 AM on the last day indicated in your booking confirmation. Please make sure that all key sets received upon arrival are returned to your contact person. Upon request and subject to availability, the check-out time can be extended. For example, if you need extra time in the apartment due to a late flight, we will do our best to accommodate your request, provided the apartment is not occupied and/or dirty. This service incurs an additional cost.
Cleaning and Bedding
Full cleaning is done before and after the departure of new guests. Weekly cleaning is not included for longer stays, i.e., 2 weeks or longer, but extra cleaning can always be arranged at an additional cost. Thorough final cleaning is included in the price, but we ask our guests to leave the property in tidy conditions, dispose of waste, and clean dirty dishes as a courtesy to our cleaners and future guests. Please note that we provide one large towel (140x70cm) and one medium towel (100x50cm) per person. If you need additional bedding during your stay, we can arrange it for a small supplement.
Special Requests
Our goal is to meet the needs of our guests. Please contact us if you need additional service or a special request. We will do our best to make your stay as enjoyable as possible.
People with Reduced Mobility
A limited number of accommodations in our portfolio have easy access and may be suitable for special needs. If you need more information, please contact us before booking, and we will be happy to assist you.
Number of Guests
The maximum number of guests allowed in an apartment is indicated in the descriptions of each accommodation. For health and safety reasons, it is not allowed to use the accommodation for a greater number of guests than indicated in the reservation confirmation. Non-compliance with this rule may be grounds for termination of the contract by "the Company," and it reserves the right, if deemed necessary, to expel guests not confirmed in the original reservation.
Behavior
At ViVi Homes, we want our guests to enjoy their stay. We ask everyone to maintain respectful and social behavior, both in the house and with neighbors. Please note that, even though you are on vacation, you will be staying in a private property surrounded by local people. If, for any reason, a complaint, claim, or report is made by neighbors or the competent authority regarding the behavior of one or more guests, you may be asked to leave the property, and there will be no refund. Additionally, any damage or breakage will be deducted from the deposit. Please be aware that most communities in Spain have their own rules that guests must adhere to.
In general, we ask that you do not:
- Damage furniture or property.
- Make noise after 9:00 PM in the apartment, on the terrace, or in common areas.
- Disturb neighbors by opening/closing doors, carrying suitcases, etc.
- Hold noisy parties or celebrations in the apartment.
- Organize illegal activities on the premises.
- Smoke on the property. (Violation of this rule incurs a fine of 250 euros.)
- Bring pets to the property.
- Use a charcoal grill.
Please note that:
- The accommodation owner (or ViVi Homes on behalf of the owner) reserves the right to expel guests without a refund if property rules are not followed.
- ViVi Homes is not responsible for theft or accidents on the property.
- ViVi Homes is not responsible if a specific property is not suitable for occupation due to force majeure.
- Some apartments or features may be changed, replaced, or removed at any time without prior notice
- ViVi Homes is not responsible for the closure of amenities, facilities or public areas in the private complexes where our managed houses are located. These complexes are managed by the apartment owners, and these may be closed or rendered out of order due to repairs, maintenance, seasonal use, or other reasons, often without prior notice. While we strive to provide accurate and up-to-date information, we cannot guarantee the availability of such facilities during your stay. Thank you for your understanding.

Pets
Please note that pets are not allowed in our accommodations. If you are traveling with a guide dog (for example, visually impaired, police dogs, etc.), please contact us before booking so that we can find suitable accommodation for you.
Complaints
If you have any complaints during your stay, please notify us as soon as possible so that we can resolve them immediately. The company will not accept any complaints made after your stay. We will always do our best to resolve any complaint that may arise as efficiently as possible. Please note that there is an official complaint form from the Andalusian Board available upon request.
Security Deposit
A security deposit is required. The deposit will be refunded upon departure, provided that no anomalies, breakages, or defects are found during the inspection of the property, furniture, appliances, and other elements. If found, it will be deducted from the deposit refund. We reserve the right to use all or part of the deposit to cover the cost of repairs or replacements that we have had to make. The deposit varies from one property to another but generally ranges between 100 and 1.000 euros.
Accommodation Changes
In the event of changes to the reserved accommodation due to force majeure, fortuitous events, maintenance issues, etc., the company reserves the right to change the assigned accommodation to another of equivalent or higher level than the one you have booked, with your approval, or proceed to the full or partial refund of the reservation cost.
Responsibility
- 'The Company' is not responsible for the loss or misplacement of luggage, thefts, damages, or accidents unrelated to the management of 'The Company.' - The guest agrees to make proper use of the rented accommodation, thereby releasing 'the company' from any liability; the guest may be responsible for damages intentionally caused or otherwise by improper use of the accommodation.
- 'The Company' reserves the right to update any of these terms at any time if the activity of 'the Company' requires it.
- The protection of users' personal data by ViVi Holiday Homes S.L. complies with Organic Law 15/1999 on the Protection of Personal Data. We inform you that your data is kept in the file for which 'the company' is responsible, with the purpose of managing the property.
- They are also used, and only if the client has registered, to inform about related services, offers, and marketing campaigns.
- The online reservation of user services is voluntary with the provision of personal data (hereinafter "personal data"), the sole purpose of which is to complete the reservation.
- Data provided by the company's payment card, in a payment gateway belonging to the bank entity with which this company has signed up for this service or made in a secure environment, in which case 'the company' will not know such data.
- Customers can exercise the rights of access, opposition, rectification, and cancellation of data by writing to the company, ViVi Holiday Homes S.L., Calle Almendralejo de Jarales 5, 29649 Sitio de Calahonda (Malaga, Spain). 'The Company' guarantees that it has taken appropriate security measures in its facilities, systems, and files. It also guarantees the confidentiality of 'personal data,' while revealing to competent authorities the 'personal data' and other information in its possession or accessible through its systems and required in accordance with applicable laws and regulations.
- Users of the online reservation system guarantee and, in any case, the truthfulness, accuracy, validity, and authenticity of the 'personal data' and undertake to keep 'the company' informed.
Applicable Law and Jurisdiction
- These conditions and/or the general conditions are governed by Spanish law.
- ViVi Homes and users, to resolve any dispute that may arise regarding its validity, execution, or termination, total or partial, submit, with express waiver of their own jurisdiction or others that may correspond to them, to the jurisdiction of the courts of the city of Malaga.
- This contract constitutes the entire and complete agreement between ViVi Holiday Homes S.L. and the user, replacing all previous commitments, statements, or agreements, written or verbal, that may have existed previously between them.
